UPDATE (4/1/14): The situation of undocumented studens in Arizona has positively changed since the introduction of the Deferred Action process (DACA). However, dreamers who have not applied to DACA because are still in High School or lack of funding need to be aware the danger of deportation is present.
We know of sad instances where DREAMers are caught working without the proper documentation in order to be able to gather funds to apply for DACA, have been detained on workplace raids and charged with identity theft (a felony which potentially can derrail DACA application and their dreams).
Ideally, DO NOT work without proper documentation, and if so and caught in a raid, DO NOT sign any felony conviction without the proper legal advise of an experienced lawyer knowledgable in criminal, immigration law. Report any instances to The ADAC hotline (480)-788-1414

Your daily responsibility:
Be always informed on the changes on the laws and procedures. It is your responsibility to be up-to-date on the news. Be aware of your Rights in the areas of immigration, civil, federal laws.

1- Have all personal documents (e.g. school, medical records) together and in a place where close relatives or friends have access in case of an emergency.
2- Have the contact information of some attorneys in case you get stopped. Have contact numbers of family and friends. All the numbers must be land telephone lines, no cell phones.
3- Form support groups in your community, church, school, and work, etc, for information and in case of problems with immigration.
4- Consult your current situation with an attorneyand seek advice.
5- Have a plan ready in case you are dismissed from work, arrested or deported.
6- Never leave home without 50. us dlls in cash for emergencies.
7- Never disclose your immigration situation.
Obey all laws
• This means no jaywalking, loitering, riding a bicycle on the sidewalk when there is a clearly marked bike line, riding a bike against traffic, etc.
• Do not drive a vehicle if you do not have a valid AZ driver’s license.
If you are stopped….
Increasingly, police authorities are acting as immigration enforcers and have been stopping students on the slightest infraction.
Do not answer any immigration related questions to a police officer.
Do not run at the sight of a police officer or other authority.
If you are a minor, tell the police you will not give more information without the consent of your parents, guardians and your lawyer.
In case of a traffic stop, also provide:
Vehicle registration
Proof of car insurance
If you are stopped by a police officer, follow all his/her instructions and be cooperative and respectful but firm.
Do not disclose your immigration status or any other information concerning your immigration situation.
Never:
Never give a false name
Never give a fake document or a document of another country that you have not obtained personally
Never run from the scene
Never admit anything
Showing a foreign document can make the police officer suspicious of your immigration status and give him/her grounds to call immigration authorities.
If your vehicle is impounded, do not seek to retrieve it yourself. Look for an attorney’s advice.
If you have not committed an infraction, ask the officer if you may continue on your way. Insist on your right to continue on your way and do not engage in further
conversation or explanation.
If you are treated unfairly and rudely, ask the officer his name and badge number. Write it
down and report it later to advocates and the police department.
In case of detention by immigration authorities….
Insist on your rights. You may not hear your Miranda rights.
1- Anything you say can be used against you. Only give your name.
2- Request access to your attorney. Do not sign any paper or provide any information unless your lawyer is present.
3- Do not admit anything without the advice of an attorney.
4- Although you have the right to contact the Consulate of your country of origin, we
discourage this situation because the immigration agents want to know the country of
origin of the detainees.The immigration agent’s objective is to gather
information regarding when, where and how an immigrant entered the country. The information gathered is used to determine what charges are to be presented and where to deport the detainee.
It is very important not to offer any information because certain individuals can face federal charges and federal prison time before deportation.
The ICE agents will likely be coercive, intimidating and question or ignore your
request for a lawyer.
In Case of Incarceration:
No matter what immigration agents may tell you,
deportation or any other legal action WILL
ALWAYS remain on a personal record, nothing should be signed or agreed without the presence of an attorney.
In Case of Incarceration:
Ask to speak with an attorney. You must provide your own attorney so have an attorney’s contact information you trust.
Always carry cash to purchase items from the commissary like mailing supplies, personal hygiene items, food, etc.
Carry cash to purchase phone usage time. Calls are collect and only work for land line phones,
NO CELL PHONES.
Always have your list of contacts and attorney’s numbers ready. The list of numbers you have must be of reliable people who can contact an attorney or help.
Some home phone numbers do not accept blocked calls. The detainee must pay for the calls (calls are purchased only once a week, so use the money wisely).
